Terms

These terms cover your use of thefreshbake.com, run by Deliberate Pty Ltd, PO Box 32, Bassendean WA 6054, Australia ("we"). By using the site you accept them. Nothing here limits rights you have under the Australian Consumer Law or similar laws that can't be excluded.

The directory

Listings describe other people's products. Unclaimed listings are written automatically from the product's own website, and claimed listings by their owners. We don't check, endorse or take responsibility for any listed product or site, or for anything you do on them. Linked sites have their own terms. The kitchen staff named on the site are fictional, and any "recommendation" from them on a paid listing is advertising.

Submitting and claiming

If you submit or claim a listing, you confirm that you're entitled to, and that what you write is true and doesn't break any law or anyone's rights. You give us permission to show it, with your site's icon, screenshot and details, on the site and in what we publish about it. You can edit or remove your listing at any time through the bakers' entrance. A claim from an address on a listing's own domain can take over from someone who submitted it with another address. We may edit, refuse or remove any listing, and may list or decline to list any site, at our discretion.

Paid listings

A Super fresh listing costs US$6 a month, plus any tax shown at checkout, and renews monthly until cancelled. Stripe takes the payment. You can cancel any time from your listing's page, and it stays paid to the end of the month you've paid for. We don't refund the rest of a month you've started, except where the law requires it.

Paying gets you the golden row, steam and random turns on the pastries shelf. It doesn't promise clicks, customers, a position, or any particular share of the shelf, which depends on how many others are paying. If your listing is removed for breaking these terms, or you remove it, or someone on its domain takes it over, the subscription stops. If we change the price, we'll tell you first, and you can cancel before it applies.

Fair use

Don't try to break the site, get round its limits, inflate click counts, scrape it in a way that burdens it, or use it to send spam or mislead anyone.

Our liability

The site is provided as is, and may change or stop. To the extent the law allows, we aren't liable for indirect or consequential loss, and our total liability for anything to do with the site is limited to what you paid us in the 3 months before the claim, or the cost of supplying the service again.

Changes and law

We may update these terms, and the version here applies from when it's posted. Western Australian law applies, and its courts have jurisdiction. Questions: hello@thefreshbake.com.
